These Terms of Service (the "Terms") govern your access to and use of the website at purelypeptides.org (the "Site") and your purchase of any products from it. The Site is operated by Purely Peptides LLC, an Arizona limited liability company ("Purely Peptides," "we," "us," or "our"). By accessing the Site or placing an order, you agree to these Terms, our Privacy Policy, our Shipping Policy, and our Consumer Health Data Privacy Policy, each of which is incorporated by reference. If you do not agree, do not use the Site or place an order.
All products sold by Purely Peptides are intended strictly for in-vitro laboratory research, educational, and scientific purposes only. These products are not intended for human or animal consumption, clinical use, diagnostic use, therapeutic applications, or any other use that would constitute administration to a living organism.
By placing an order, you represent and warrant that (a) you are a qualified researcher, scientist, or laboratory professional; (b) all products will be used exclusively for lawful in-vitro research; and (c) you will not administer, or permit the administration of, any product to a human or animal. You assume all responsibility and risk for the safe handling, use, storage, and disposal of the products.
You must be at least 21 years of age (or the age of majority in your jurisdiction, whichever is greater) to use this Site or purchase any products. By accessing the Site, you confirm that you meet this requirement. Purely Peptides reserves the right to refuse service, or to request verification of age or professional qualification, and to cancel any order at its sole discretion.
The buyer is solely responsible for determining whether the purchase, possession, handling, and use of any product complies with all applicable federal, state, and local laws and regulations. Purely Peptides makes no representation regarding the legal status of any product in any specific jurisdiction.
Purely Peptides is not a pharmacy, compounding facility, outsourcing facility, or medical provider as defined under any federal or state statute. We do not provide medical advice, diagnoses, prescriptions, dosing guidance, or clinical consultations of any kind, and nothing on the Site should be construed as such.
Purely Peptides takes reasonable measures to support product quality and purity for research use. However, all products are sold "as is" and "as available" for research purposes only. To the fullest extent permitted by law, we make no warranties, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or results of use in any research application.
All orders are processed and fulfilled manually. The payment methods available to you are those displayed at checkout, which currently include cryptocurrency. Payment must be received and confirmed before an order is shipped. Purely Peptides reserves the right to cancel any order at its sole discretion, in which case any amount received for the cancelled order will be refunded.
Prices are subject to change without notice. The price displayed at the time of order confirmation is the price that applies to that order. You are responsible for providing accurate order and delivery information.
Shipment timing. We ship within the time stated at checkout or, if no time is stated, within 30 days after your payment is confirmed. If we cannot ship within that time, we will notify you and offer you the option either to consent to a delay or to cancel the order for a full refund, consistent with the FTC Mail, Internet, or Telephone Order Merchandise Rule (16 C.F.R. Part 435).
Purely Peptides ships within the United States only, including the District of Columbia, Puerto Rico, and the U.S. Virgin Islands. We do not ship internationally. Please refer to our Shipping Policy for rates, timelines, and details. We are not responsible for packages that are lost, stolen, or damaged after delivery has been confirmed by the carrier, except as provided in Section 7.
Due to the nature of research chemical products, all sales are final and we do not offer returns, except as required by law or as stated in these Terms. We stand behind safe delivery: if your order is lost in transit or arrives damaged, we will reship it free of charge. For a damaged, incorrect, or missing item, contact us at [email protected] within 48 hours of delivery (or expected delivery) with photographic evidence, and we will arrange a replacement. This section does not limit any refund we are obligated to provide under Section 5 or applicable law.
To the fullest extent permitted by applicable law, Purely Peptides, its owners, members, employees, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, or goodwill, arising from or related to your use of, or inability to use, any product or the Site, even if advised of the possibility of such damages. Our total aggregate liability for any claim arising out of or relating to a product or these Terms shall not exceed the amount you paid for the product giving rise to the claim.
Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law, including liability for gross negligence, willful misconduct, or fraud.
You agree to indemnify, defend, and hold harmless Purely Peptides and its affiliates, owners, members, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use, handling, storage, or disposal of the products, your violation of these Terms, or your violation of any law or the rights of any third party.
All content on this Site, including text, images, product descriptions, and research citations, is the property of Purely Peptides or its content suppliers and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from Site content without our prior written permission.
Please read this section carefully — it affects how disputes are resolved.
Any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or any product shall be resolved by binding individual arbitration administered by a recognized arbitration provider under its consumer arbitration rules, seated in Arizona. You and Purely Peptides waive the right to a trial by jury and agree that disputes will be brought only in an individual capacity, and not as a plaintiff or class member in any class, consolidated, or representative proceeding.
You may opt out of this arbitration agreement by emailing [email protected] within 30 days of your first order, with the subject line "Arbitration Opt-Out." Either party may bring an individual claim in small-claims court where jurisdiction and venue requirements are met. If any portion of this Section is found unenforceable, the remainder shall remain in effect, except that if the class-action waiver is found unenforceable, this entire Section shall be void.
We may modify these Terms at any time. When we do, we will update the "Last updated" date above. Changes are effective when posted. Your continued use of the Site or placement of an order after changes are posted constitutes acceptance of the revised Terms. If you do not agree to the changes, discontinue use of the Site.
These Terms are governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict-of-law provisions. Subject to Section 11, any action not subject to arbitration shall be brought exclusively in the state or federal courts located in Arizona.
These Terms, together with the policies incorporated by reference, constitute the entire agreement between you and Purely Peptides regarding the Site and supersede any prior agreements. If any provision is held unenforceable, the remaining provisions remain in full force. Our failure to enforce any provision is not a waiver. You may not assign these Terms without our consent; we may assign them to an affiliate or successor. We are not liable for any failure or delay in performance caused by events beyond our reasonable control (force majeure).
